CONDITIONS OF PURCHASE
This information is valid for travel until 1 April 2006. This
information will be updated as necessary. This copy was produced on 14th October
The selling agent must provide the client with a copy of these
conditions of purchase.
Prices include unlimited kilometres, tax and vehicle insurance. All
prices listed in this brochure are in New Zealand Dollars.
No bookings are confirmed until a payment of $500.00 (or the hire value
if it is less than $500.00) is received by Motorcycling Downunder. Payment of
the full cost of the trip must be made 30 days prior to travel. If payment has
not been made by the agent, Motorcycling Downunder reserve the right to charge
the client directly or cancel the provisional booking. Insurance bonds are
payable to Motorcycling Downunder at time of arrival.
Payment must be made in full 30 days before departure.
- All cancellations must be received in writing and they are subject to a
cancellation fee as follows:
- All cancellations after confirmation are subject to NZ$100.00 per person
- Cancellations received within 30 days of departure; each will be
considered individually and an equitable refund made after calculating costs
incurred by operators and their agents.
- Cancellations made up to 7 days prior to departure, on day of departure or
after travel has commenced receive no refunds.
The company will be under no obligation to make refunds where:
- Clients amend their itinerary after departure.
- Circumstances arise beyond the company's control, necessitating
alternative arrangements to be made to ensure the safety and/or further
participation and enjoyment of the client's holiday.
- Clients do not appear for any tour, accommodation, service, sightseeing or
package module without having notified the company; or a client leaves any
tour after it has begun, missed any scheduled sightseeing, departure,
activities or accommodation on the tour.

Motorcycling Downunder reserves the right to substitute booked
motorcycles with others of a similar or higher standard if necessary. Certain
models may be replaced or deleted when updating the fleet. Motorcycles listed
are representative of what is available at the time of print.
Goods and Services Tax
All prices featured in this brochure include New Zealand's "Goods and
Services Tax", (currently at 12.5%). Any items purchased in New Zealand will be
subject to GST.
Motorcycling Downunder is not liable for and deny all responsibility for
personal injury or damage arising out of these activities. The company and it's
agents or representatives are not responsible and expressly disclaim any
liability for any injury, damage, loss, delay, change in itinerary or schedules,
shortened vacation time, additional expense, inconvenience or irregularity,
whether to person or property incurred during the holiday in connection with or
relating to the supply or omission of air, sea, land transportation services or
of hotel, entertainment or other accommodations, facilities, meals, other
services or illness of client.
The company will not be responsible or liable (for damages, refund or otherwise)
for: mechanical breakdowns, government actions, speeding tickets, parking
tickets, weather, acts of God, strikes, compulsory quarantine or other
circumstances beyond it's control. Unpaid speeding tickets and parking tickets
are the responsibility of the rider and will be charged to the client as well as
a $30.00 handling fee.
The failure of the client to obtain required documentation (eg passports, visas,
The failure of the client to follow instructions, including but not limited to
check-in and check-out places and times.
The delay of, loss of, or damage to participants' baggage or contents,
regardless of whether it was checked with any carrier, provider of accommodation
All prices quoted in the attached itineraries, including rates and tour costs,
are those current at date of publication, subject to alteration at the absolute
discretion of the company, and in particular, but not limited to when there are
tariff or fare variations or currency exchange fluctuations.
No refunds are payable on unused sections of tour itineraries, excursions or
accommodation not availed or where passengers amend, cancel or otherwise vary
arrangements after departure.
These conditions cannot be varied or altered or waived by any servant, agent or
representative of Motorcycling Downunder, or any person providing services or
facilities. Motorcycling Downunder will not be bound by any representative
purported to have been made on their behalf unless they confirm or have
confirmed to make a presentation in writing.
Motorcycling Downunder reserve the right without payment of compensation, and
whether before or after the commencement of travel, to exclude any person if the
person may appear to endanger the health or safety or to impair the comfort of
other people. He/she may be asked to leave the tour immediately should he/she
commit an illegal act. Motorcycling Downunder reserves the right to alter
itineraries to suit amended reservations and for logistical reasons.
In the event of the motorcycle being confiscated whilst in the clients hireage,
any costs or loss to Motorcycling Downunder must be paid by the hirer.
Responsibilities of Other Transport Operators
The transport companies or firms concerned are not to be held
responsible for any act, omission or event during the time passengers are not on
board their aircraft and/or conveyances. The passengers' tickets in use by the
carriers when issued shall constitute the sole contract between the
transportation companies or firms and the purchaser of these tours and/or

This contract is governed in all respects by the law of New Zealand and any
legal action arising under the contract shall be litigated only in the
appropriate court in Christchurch, New Zealand. Bookings are accepted strictly
in accordance with these written conditions and the responsibilities detailed
above and the payment of the deposit shall be deemed to be an acceptance of
